Article 1 – Identification of the seller
The website cartes-japonaises.fr (hereinafter “the Website”) is published and operated by Davys Masker, sole trader (entrepreneur individuel), 4, rue Bastion de l’Évangile, 17000 La Rochelle, France, SIRET 443 291 893 00024, who can be contacted at [email protected] (hereinafter “the Seller”). Other legal information is given in the legal notice.
Article 2 – Purpose and scope
These terms and conditions of sale (hereinafter “T&Cs”) govern distance sales concluded on the Website between the Seller and any natural person acting for non-professional purposes (hereinafter “the Customer”). They apply to the exclusion of any other conditions.
The Customer declares that they have the legal capacity to enter into contracts. Any order constitutes full and unreserved acceptance of the T&Cs in force on the day of the order, which the Customer acknowledges having read and accepted by ticking the box provided for this purpose before confirming their order. The Seller may amend the T&Cs at any time; the T&Cs that apply are those in force on the date of the order.
Article 3 – Products
The Website offers for sale Japanese collectable cards (Pokémon cards, amiibo cards) sold individually, as well as sealed products (booster packs). The cards sold individually are second-hand goods, genuine, and purchased by the Seller in Japan.
Each product page presents the essential characteristics of the card (name, set, number, rarity, language) and real photographs of the copy offered for sale, which allow the Customer to assess its condition. Colours may vary slightly depending on the screen used. Unless otherwise stated, the cards are not graded. Sealed products are sold new, in their original packaging.
Offers are valid while stocks last. As most cards are one-off copies, if a product turns out to be unavailable after the order has been placed, the Customer will be informed without delay and refunded the corresponding amount within fourteen days at the latest.
Article 4 – Prices
Prices are shown in euros, inclusive of all applicable taxes, excluding delivery costs. Delivery costs are shown to the Customer before the final confirmation of their order and appear in the order summary.
The Seller reserves the right to change its prices at any time; the product is invoiced at the price in force at the time the order is confirmed.
Article 5 – Ordering
To place an order, the Customer selects the desired product(s) and adds them to their basket, then enters their contact details and delivery address, chooses the shipping method, reviews the summary of their order (products, prices, delivery costs) and may correct any errors. They then accept these T&Cs and confirm their order with an obligation to pay.
The sale is concluded when the Seller receives payment. A confirmation summarising the order is sent to the Customer by email. The Seller reserves the right to refuse or cancel any order from a Customer with whom there is an ongoing dispute over the payment of a previous order.
Orders can also be placed without creating a customer account. The data recorded by the Seller constitutes proof of all transactions.
Article 6 – Payment
The price is payable in full on the day of the order. Payment is made online by one of the payment methods offered on the payment page. Transactions are processed by a secure payment provider; the Seller never has access to the Customer’s banking details.
The Seller retains ownership of the products until the price has been paid in full.
Article 7 – Delivery
Products are shipped from France by La Poste, exclusively as tracked letters: Lettre verte suivie (tracked green letter) for France and Lettre suivie internationale (international tracked letter) for the other countries of the European Union. Deliveries are made to mainland France, Monaco and the countries of the European Union; for any other destination, the Customer is invited to contact the Seller before ordering.
Delivery costs depend on the weight of the parcel; they are detailed on the Shipping page and shown to the Customer before the order is confirmed. Delivery is free for purchases of €50 or more in France and €100 or more in the other countries of the European Union.
Each card is packed in a sleeve, between two rigid cardboard sheets with bubble wrap, in an envelope; a top loader can be added as an option, at the price shown on the product page. The indicative delivery time is given when the order is placed; failing that, the Seller delivers the products no later than thirty days after the conclusion of the contract, in accordance with Article L.216-1 of the French Consumer Code. A tracking number is sent to the Customer by email when the order is shipped.
The risk of loss of or damage to the products passes to the Customer when the Customer, or a third party designated by them, takes physical possession of them (Article L.216-4 of the French Consumer Code). In the event of delay, loss or a damaged parcel, the Customer is asked to contact the Seller as soon as possible, enclosing photographs if possible.
Article 8 – Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen days from receipt of the product to exercise their right of withdrawal, without having to give a reason or bear any costs other than those set out below.
To exercise this right, the Customer notifies the Seller of their decision by means of an unambiguous statement, by email to [email protected] or by post to the Seller’s address, using if they wish the withdrawal form set out in the appendix.
The Customer returns the product to the Seller without undue delay and no later than fourteen days after communicating their decision. The direct costs of returning the product are borne by the Customer. The product must be returned in the condition in which it was received, suitably protected; the Customer may be held liable for any loss in value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the product. For valuable cards, a tracked shipment is strongly recommended.
The Seller refunds all sums paid, including the initial delivery costs (up to the cost of the least expensive standard delivery method offered), within fourteen days at the latest of the date on which it is informed of the decision to withdraw. It may defer the refund until it has received the product back or until the Customer has provided proof of having sent it. The refund is made using the same means of payment as that used for the order, unless the Customer expressly agrees otherwise.
Article 9 – Statutory guarantees
The Seller is bound by the statutory guarantee of conformity (Articles L.217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), under the conditions set out below.
The consumer has a period of two years from delivery of the goods to enforce the statutory guarantee of conformity if a lack of conformity appears. For second-hand goods, during a period of twelve months from delivery of the goods, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
The statutory guarantee of conformity allows the consumer to obtain the repair or replacement of the goods or, failing that, a price reduction or termination of the contract. The consumer may suspend payment of all or part of the price until the seller has fulfilled its obligations. The seller may refuse to bring the goods into conformity if this is impossible or entails disproportionate costs; as second-hand cards are most often one-off copies, replacement may be impossible, in which case the consumer may obtain a price reduction or termination of the contract with a refund.
A seller who, in bad faith, obstructs the implementation of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
Any claim under the statutory guarantees must be sent to the Seller at [email protected], together with the order number and photographs of the product.
Article 10 – Liability
The Seller cannot be held liable for non-performance of the contract in the event of force majeure within the meaning of Article 1218 of the French Civil Code, nor for damage resulting from the use of the Internet (service interruption, external intrusion, viruses). The photographs and descriptions on the Website are provided with the greatest care; they bind the Seller only to the extent of its legal obligations.
Article 11 – Intellectual property
The texts, photographs and graphic elements of the Website are the property of the Seller; any reproduction without permission is prohibited. Pokémon and the card illustrations are trademarks and works of Nintendo, Creatures Inc., GAME FREAK inc. and The Pokémon Company; amiibo and Animal Crossing are trademarks of Nintendo. The Seller is an independent reseller, not affiliated with these companies.
Article 12 – Personal data
The Customer’s personal data is processed by the Seller for the management of orders and customer relations, in accordance with the GDPR. The Customer has in particular rights of access, rectification and erasure, detailed in the privacy policy.
A Customer who does not wish to receive telephone marketing may register free of charge on the Bloctel list of consumers opposed to telephone canvassing (www.bloctel.gouv.fr).
Article 13 – Complaints and mediation
For any complaint, the Customer should first contact the Seller at [email protected]; an amicable solution will be sought.
In accordance with Articles L.611-1 et seq. of the French Consumer Code, if this approach fails, the Customer may use, free of charge, the consumer mediator to whom the Seller is attached: [TO BE COMPLETED: name, postal address and website of the consumer mediator]. The Customer may refer the matter to the mediator only after having tried to resolve the dispute directly with the Seller by means of a written complaint, and no later than one year after that complaint.
Article 14 – Governing law and disputes
These T&Cs are drafted in French and are governed by French law. Failing an amicable resolution, any dispute falls within the jurisdiction of the competent courts under the ordinary rules; the consumer may bring the matter, at their choice, before the court of the place where they lived at the time the contract was concluded or the harmful event occurred (Article R.631-3 of the French Consumer Code).
